Mystery Ranch Recalls Quick Draw Holsters

Mystery Ranch issued a recall on November 13th, 2019, for its Quick Draw Side Arm Holsters. These holsters are made for various semi-automatic handguns and are meant to be placed on the hip. However, the retention strap that keeps the gun in place is defective and can cause the handgun to fall from the holster. Upon falling, the gun may discharge or fire. Mystery Ranch Recalls Quick Draw Holsters The holsters have an exterior made of camel hypalon, and the interior has a foam cushion. The holster snaps closed with a small button. The tracking tag has the following information on it: “Mystery Ranch; Date on Tracking Tag: 28 May, 2019; Bundle No.: 294411; Line: S-B and Inspection: M-V.” The UPC number is 888564163139. 500 of the units were recalled in total. The holsters cost about $25 and were sold for three months from August 2019 through October 2019. They were manufactured in the Philippines and imported by Mystery Ranch in Montana. To date, there have been 42 reports of the holster strap disconnecting, resulting in at least one instance where the gun fell from the holster. Fortunately, there have been no injuries reported from an accidental discharge. Mystery Ranch has been contacting known purchasers directly to advise them about the item. Users should stop using the holsters to carry their guns and return them to the store for a full refund.

Accidents from Broken Gun Holsters

A broken gun holster is extremely dangerous as a conduit to accidents. It is possible that someone could holster his weapon only for the holster to fail to contain it, leading to it falling and firing. This can be extremely dangerous and even lethal if the individual is in a crowded area. A single gunshot is, of course, enough to kill someone, and all gun owners should be extremely careful, no matter. Part of the issue with defective holsters is that they usually work fine most of the time. The accident is not something that happens every time the gun is holstered or the holster would never be used. The fact that it could fail so suddenly is part of the high risk with the item. Further, gun owners should practice gun safety at all times. If they do not turn the safety on on the gun when holstering it, they run the risk of accidentally discharging the weapon even when extracting it. If a gun has the safety turned of when it falls out of a holster, it could easily fire, especially if the trigger is very sensitive. Gunshots can cause numerous types of injuries, including the following:
  • Internal bleeding
  • Fractures
  • Shattered bones
  • Internal organ damage
  • Flesh wounds
  • Disfigurement
  • Permanent scarring
  • Infections
  • Organ failure
  • Paralysis
  • Death
These injuries are extremely serious and can result in permanent damage at times. It is important that you get appropriate treatment and you pursue necessary legal action against the negligent party. Our product liability lawyers can assist you.

Filing a Product Liability Lawsuit

If you wish to file a product liability lawsuit, you must be able to show that Mystery Ranch was liable in some way. Product liability claims are personal injury lawsuits, and therefore, there must be negligence at hand. While normal personal injury claims require you to show how the company or party was negligent and caused an accident, product liability claims are slightly different. They have three requirements, and any of them can be shown to be true for your claim. They are as follows:
  • There was a design flaw with the product that was not caught before the item was sent to be created
  • There was a manufacturing error with the item that happened when a machine broke, wrong parts were used, assembly lines did not work, and more
  • There were no warnings on the packaging or any hazard symbols or statements on the item itself
Because a holster is expected to work appropriately from the start, there is no need for hazard symbols on the item itself. There was likely a design flaw or manufacturing error with the holsters that caused them to stop working. The strap could have been affixed improperly or the wrong button could have been used. In order to file our claim, you will need ample evidence. We recommend following these steps to securing the proof you need to move forward with your claim: Go to the hospital as quickly as you can to acquire medical attention if you were seriously injured from a gunshot. While at the hospital, you should keep the receipts from the hospital, the medicine you were prescribed, the doctor’s notes, and more. It is important that you do not wait to go to the doctor; if you do, the insurance agent handling your case can claim that you were hurt elsewhere. You should keep as many receipts or proof of purchase documents as you can, if you still have them, such as emails or paper receipts from a store. You could also print a copy of your credit card statement or bank statement to show a purchased made to the relevant store or retailer. This will show that you were the actual buyer and owner of the product. If there were any other bystanders who witnessed the accident happen or who also purchased defective gun holsters, you can add their statements and testimonies to your package of evidence. Additionally, you should refrain from tampering with the holster in any way. You should also not take it to any shop so that it can be repaired or return it to the store. If you do so, it is likely that you will lose your primary piece of evidence and will be unable to secure any restitution for your claim. Once you have gotten all the proof you need, you should find a lawyer with experience in product liability claims. You may not have the ability to handle a claim by yourself, as most people do not have the legal knowledge, time, money, and energy required. If you hire a skilled lawyer, you can focus on recovering or returning to a normal life while we handle the legwork of the claim. We will do everything we can to win you the necessary compensation and ensure that your losses are properly covered.

Statute of Limitations to Sue Mystery Ranch for a Product Liability Lawsuit

California’s statute of limitations on personal injury lawsuits, which includes product liability claims, is 2 years from the date of the injury. You do not have an unlimited time to sue. If you do not file a claim quickly, you will be barred from pursuing any additional compensation in the future. It is recommended that you move fast so that your evidence will remain fresh and not be corrupted. The longer you wait, the more likely it is that you will lose something crucial. There are a few scenarios in which the statute of limitations can be extended beyond the 2-year deadline. This may happen in the event a victim was underage, which would case the statute to begin on the victim’s 18th birthday, or when the victim is left incapacitated, leading to a statute that begins when he returns to health or awareness. It is not uncommon to see claims miss being filed because the victim does not know about the statute of limitations. Talk with our attorneys to ensure that you file a claim on time.
