JAKKS Pacific Mario Kart 24V Ride-On Racer Recall Class Action Lawsuit
On April 25, 2024, JAKKS Pacific issued a recall for their Mario Kart™ 24V Ride-On Racer Cars. According to the recall (24-210), if the acceleration pedal on the ride-on toy becomes clogged with debris, it can stick even after the user’s foot is off the pedal; this poses a crash risk. The recall affects approximately 17,500 units of the product.
The recalled ride-on racers are red, white, and blue and have a letter “M” in a white circle in the front of the vehicle. The toy racers have 8-character alphanumeric manufacturing date codes (in XXXXVEO1 format) located on the bottom of the blue panel on the underside of the product.
Ony the products with the following manufacturing date codes are included in the recall:
- 1752VE01
- 1782VE01
- 1952VE01
- 2242VE01
- 2352VE01
- 2852VE01
- 0583VE01
The products that are still being sold in stores are not included in the recall.
The affected products were sold both online and in-store at Target, Walmart, Entertainment Earth, and Nebraska Furniture. They were sold exclusively online via Amazon.com, Macy’s, and Game Stop. The defective racers were available from October 2022 through January 2024 for approximately $400.
So far, the company has received at least 65 reports of the pedals getting clogged with debris and sticking. This includes 15 reports of the vehicles crashing into permanent structures. There has been one minor injury associated with these incidents (a chafed hand).
The company is urging all affected consumers to stop using the product and contact them to receive a free repair kit (a replacement pedal with installation instructions).
If your child sustained injuries due to the defective Mario Kart Ride-On Racer Cars, it is important that you do not accept a repair kit. Rather, you should explore the legal options available to you. You could have the right to sue based on the concept of product liability.
