Humanscale Recalls Thousands of QuickStand Lite Workstations

On September 17, 2019, Humanscale Corporation issued a recall for its Quickstand Lite workstations. These workstations are essentially moveable stands with control arms that hold monitors and keyboards. The product was recalled due to a hazard with the arm – the arm could break or crack under the weight of the monitor and keyboard, which would make the entire workstation fall over and come off the stand. Humanscale Recalls Thousands of QuickStand Lite Workstations The workstations have adjustable height stands, two platforms for a keyboard and a dual monitor setup, and come in black and white colors. They are about 19 inches high and 25 inches wide. About 22,000 of the units were recalled, with an additional 2,000 being recalled from Canada. The items were manufactured in China and imported into the US to be sold through Humanscale stores, furniture stores, online retail outlets, Fellowes.com, and other websites and locations. They were sold from January 2015 through November 2018 at a cost of about $600. There have been over 50 reports of the control arm breaking in some way. 12 reports were issued related to injuries suffered from the broken arm. The monitors that were attached fell on the customers and caused minor injuries. Humanscale has requested that users stop using the product and detach it from the monitors. They offer a free repair kit for all customers; you can contact the company to receive one.

Injuries from Broken Stands

Broken stands are some of the most troublesome defects to encounter. They may hold on televisions on walls, fans, lights, computers, and more. There is no telling how many pounds of pressure are on the stands, and companies may not always inform you of on the packaging of what the stand can hold. Other stands are simply ill-equipped to handle such issues and can easily break under any pressure. Humanscale stands are one such example; they may possibly break from a small amount of pressure and weight caused by a monitor and a keyboard. Some of the injuries that can be suffered from falling objects off stands include:
  • Concussions
  • Broken hands
  • Broken toes
  • Lacerations
  • Bruises
  • Abrasions
  • Traumatic head injuries
  • Collarbone injuries
  • Fractures
  • Sprains
  • Nerve damage
  • Crushing injuries
Some of the damage may aggravate previously existing injuries. For instance, if you have a history of hand problems and a monitor falls on your wrist, it could set you back months in recovery time. There could be additional damages that you now need to fix that were coming along fine before. It is important that you take the necessary precautions for protecting yourself. What should I do to file a product liability lawsuit against Humanscale?

Workstations recalled after arms break, injuring dozen workers
If you were hurt because a Humanscale workstation broke and a monitor or keyboard fell on you, you can take legal action and pursue a product liability lawsuit. Product liability claims deal with items that are poorly created or that are defective in some way. In order to file such a claim, you must be able to show at least one of these points:
  • The product had a design flaw that prevented it from working properly
  • The product had a manufacturing error that caused a noticeable defect in it, like a weak base or set of screws
  • The product did not have any warning signs or hazard signs on the item or on the packaging to warn users about potential dangers
With the Humanscale workstations, it is safe to assume that there was either a design error or manufacturing defect present with them. If you wish to sue, you should take the following actions: First, do not throw away the product, get it repaired, or sell it. If you get rid of it or return it, you will not have any hard evidence to present. There will be nothing for you to show that caused you an injury. You should also refrain from trying to fix the workstation. If you do try to fix it or tamper with it in any way, the company can claim that there is no way to determine why the accident happened. You won’t usually be able to readily show that you were fixing it, and there will be plausible deniability. You should get medical attention as quickly as you can if you were injured. Waiting too long to go to the doctor to get treatment can negatively impact your claim. When you go to the doctor, you should hold on to any notes, treatment packets, diagnoses, medication, and receipts from the facility. You can take pictures of the product ad take photos of the injuries you suffered. It will be beneficial to have as much proof of the damage as you can acquire. One of the necessary pieces of evidence that you will need to have is the receipt or proof of purchase for the workstation. Often, some people will try to get compensation by feigning injuries from items they did not buy or do not own. Lastly, it is in your best interest to find a product liability lawyer in Los Angeles to handle your claim for you. If you have never taken legal action against a company, you will not know how to proceed. You may not have the legal knowledge or negotiating experience to win your case. We will hire expert witnesses and ensure that you are appropriately represented. Your focus should be on recovering from any injuries you suffered and returning to your daily life.

What can I earn from a product liability case?

If you sue Humanscale for injuries stemming from a defective workstation, you could earn a fair amount of compensation if you were seriously hurt. The insurance agent responsible for handling your case will essentially weigh the value by looking at how severe your injuries were and how much of an impact they had on your daily life and career. If you were unable to return to work for a period of time or your job responsibilities and capabilities were permanently altered, your case’s value would increase. Similarly, if you were hurt and never able to fully recover and were left with nerve damage or a similar injury, your case would be worth a lot more. We will work to win you the following damages:
  • Medical expenses stemming from the accident
  • Lost income if you could not go to work because of your injury
  • Property damage to replace the workstation or other broken items
  • Pain and suffering to alleviate emotional trauma and other mental anguishes
You should not be expected to pay off these debts if you were injured because a company failed to provide you with a safe, working product. We will strive to win you every penny that is needed.

What is the statute of limitations on product liability claims?

In California, you have 2y ears form the date of the injury to file a product liability claim against Humanscale. The 2-year limit is in effect to make sure that claims do not take too long to be filed and that both parties have enough time to gather their evidence and form cases. You should always check with an attorney to ensure that you are operating within the correct time frame for your case. If you do not file a lawsuit within that time frame, you will be unable to collect any compensation in the future and your lawsuit will be voided. There are a few ways that the statute of limitations can be extended. For example, minors who were injured by the workstations cannot legally sue, so they can wait until they turn 18 years old before they adhere to a statute. This is the most common reason for extensions to the deadline. However, a defendant may also leave the state, which would allow the deadline to be extended until he returns.
