Cycling Sports Group Recalls Front Racks for Cannondale Treadwell Bicycles
On September 9th, 2020, Cycling Sports Group issued a recall for its Front Racks with Bamboo Trays that can be used on various Cannondale Treadwell bicycles. The racks can possibly detach, which may cause the front wheel of the bicycle to suddenly stop. If a rider is on the bike, he can fall and suffer numerous injuries. Over 1,900 of the racks were recalled.
The racks have a black metal frame and a bamboo tray to place items and belongings. The model number “ISO11243:2016 YUENI MAX 10KG” can be found on the tray. The racks were manufactured in Taiwan and imported into Connecticut. They were sold at various Cannondale dealerships from April 2019 through June 2020 and cost between $950 and $2,750 if you purchased bicycles that included the racks. The racks themselves could be purchased separately for $100.
There have been 2 separate incidents reported wherein the racks detached. Both resulted in injuries. One accident resulted in minor cuts and bruises, but the other led to bruising and a concussion. The company recommends that riders abstain from using the bikes immediately until they can get the rack removed or replaced from an authorized dealer. The company is providing free repairs to customers.
Injuries from Bike Accidents
Bicycles should always have properly working parts on them that pose no risk of injury due to breaking. If there are any defects or malfunctions, the riders can be tossed from the bikes and sustain heavy injuries, especially if they are near traffic. It does not matter if the part is crucial, like a wheel, or an add-on, like a front rack. It is extremely dangerous to ride a faulty bike, as most people ride them near traffic. You could fall off the bike due to a defect and be struck by nearby vehicles. Some of the injuries you could suffer include:
If you suffer any of these injuries from a faulty Cannondale front rack, you can take necessary legal action with the help of our firm.
Suing Cycling Sports Group for a Defective Bike Rack
If you intend on filing a lawsuit against Cycling Sports Group for injuries suffered from a faulty bicycle rack, you must show that the company acted with negligence at a certain point of the process. You can do this in one of three ways. You can show that there was a design flaw with the product, wherein the rack was not properly tested or created. There may have also been a manufacturing defect that was present with a small amount of the racks due to a faulty machine at the factory, or because faulty materials were used. You may also point out a lack of hazard signs or warnings present on the packaging or on the bicycle rack itself, which would fail to let users know of the potential dangers.
In all likelihood, there was a manufacturing defect that was present. The racks were likely not properly affixed to the bicycles.
Here’s what you need to do to file your claim:
It is generally recommended that you reach out to a lawyer for help, since many individuals do not know the first thing about filing claims. You should focus on your health while we focus on winning your claim.
Value of a Defective Product Claim against Cycling Sports Group
The more extensive and damaging your injuries, the more likely it is that your settlement will be large. However, this relies on the insurance agent handling your claim. Our attorneys will strive to bring you the maximum settlement value available under the law. We will pursue the following:
You should not have to pay for these expenses if Cycling Sports Group manufactured faulty bicycle racks and you were injured due to their negligence.
Statute of Limitations on Product Liability Lawsuits
The statute of limitations in California to file a product liability claim is 2 years from the date of the injury. If you don’t file a claim within that time period, you won’t be able to receive any coverage at all. You should act quickly so that all your evidence is intact. Waiting too long will likely damage your case. The main reason that many people fail to get the compensation they deserve is due to a lack of awareness about their statutes, and they often expire before the case is brought up.
You can have the deadline extended in some scenarios. If you were underage when the accident happened, your statute won’t count down until you turn legal age. If you were left mentally or physically unable to sue, the statute will be frozen until you return to awareness. You also cannot sue if the defendant is not in California, so the statue won’t count down until he returns.
