RENT A CAR, DRIVE FOR UBER & LYFT – Am I Covered by Insurance in an Accident?
Uber and Lyft are both rideshare services that allow drivers to use their own vehicles to pick up and drop off passengers. This allows a freedom of schedule and flexibility that is not present with taxicabs or other rid services. However, some individuals do not have their own vehicles and must resort to rentals. Uber and Lyft both partner with different companies to provide rental car vehicles for different costs each month. For example, Fair with Uber provides rentals for $185 per week, while Hertz is $214 per week. It is important to understand how these costs work and what you are paying for with each payment, including benefits and insurance. Our team of attorneys at the Downtown LA Law Group can provide you with expert assistance and free consultations if you have insurance questions or if you have been in an accident and want to know what steps to take to move forward.

Uber Rental Car Insurance: Fair, Hertz, Getaround
Uber offers insurance to drivers who are using the app, but when they are not driving for the company, they are covered with their own personal auto insurance policies. However, when driving rental vehicles, individuals are covered by the rental companies. The different companies provide insurance in the following ways.
Fair
While driving around without the app on, you are covered for $50,000 in property damage, $50,000 in bodily injury per person, and $100,000 in bodily injury per accident. Uber covers the other driving periods, with a $1,000,000 policy for liability when a ride request is granted.

Hertz
Hertz provides minimum state limits when the app is not on, and physical damage up to $1,000 when the app is on. Uber does not offer coverage while the app is off, but it does cover liability for $50,000 and $25,000 in property damage when the app is on. When on a ride, Hertz offers no coverage, but Uber provides $1,000,000 in liability and $250,000 in uninsured/underinsured motorist coverage.
Getaround
Getaround provides $100,000 in liability coverage when you are not using the app and physical damage coverage in excess of $1,000 per accident. Uber provides liability coverage, underinsured/uninsured motorist coverage, and more when the app is on and when the ride is in progress.

– Everything that You Need to Know about Fair Insurance
With Lyft, there are numerous options for insurance. When you are merely driving your own vehicle without the app turned on, your own personal auto insurance covers any accidents. However, when the app is on but you have not yet agreed to a request, you are covered for a relatively small amount, generally $50,000. This upgrades to $1,000,000 when you have accepted a request and have picked up a passenger. Rental car insurance, however, works slightly differently depending on the company from which you are renting a vehicle. We have outlined the differences below:
– Maven Rental Car Service: Rent Great Cars from People Nearby
Hertz
During the personal driving period, Hertz covers you for $50,000 for auto damage (with a $1,000 deductible), coverage for bodily damages to third parties, and the state minimums for uninsured/underinsured motorist coverage. When you are waiting for a request, you are provided the same coverage for auto damage, but Lyft provides coverage to third-parties for bodily damage and the state minimums for underinsured/uninsured motorist damage. When a ride is in progress, Lyft provides the actual cash value of the vehicle or repair costs (with a $1,000 deductible), bodily injury and damages of up to $1,000,000, and state minimums for underinsured/uninsured motorist damage. Therefore, Hertz covers you during your personal driving period, while Lyft covers you while you have a passenger in the car.
– Hertz weekly rentals
Flexdrive
During the personal driving period with a Flexdrive vehicle, Flexdrive covers the actual cash value of the car for auto damage, third-party liability, and state minimums for underinsured/uninsured motorists. While waiting for a ride request, Lyft covers auto damage, third-party liability, and uninsured/underinsured motorist damage. This is the same offer while a ride in progress, but third-party liability and liability for passengers is bumped up to $1,000,000.
Avis Budget Group
Avis covers vehicle damage for up to $50,000 during the personal driving period, coverage for third-party liability, and uninsured/underinsured motorist coverage up to the state minimums. Avis also provides the same coverage while you are waiting for a request, while Lyft takes over third-party liability and underinsured/uninsured motorist coverage. During the ride with a passenger, Lyft totally covers auto damage, liability for third-parties and passengers, and uninsured/underinsured motorist damage.

Who to Sue in the Event of an Accident
If you were involved in an accident while driving a rental car for Lyft or Uber, you will likely have the ability to sue for damages. If you were hurt because there was a problem with the rental car, you could sue the rental agency and receive compensation. If you were injured by someone driving a rental vehicle who should not have been behind the wheel, you could take legal action against the rental company and the rideshare app. If you were driving for Uber or Lyft at the time of the accident, you may be able to sue the other driver involved in the crash or take out a claim against Uber or Lyft, especially in cases of underinsured or uninsured motorist coverage.
What should I do in an Uber or Lyft rental car accident?
If you have been involved in a rental car accident while driving for Lyft or Uber, you should immediately see to it that your health is protected. You can go to the emergency room or call the paramedics to get treated (and make sure to hold on to medical notes and receipts); once you have been guaranteed safe, you can then collect other evidence. This additional evidence can include pictures of your injuries, damages done to the vehicles, and the scene of the incident.
– What is Fair Car Rental? How Does it Work?
It will also be in your best interest to get eyewitness and passenger statements and testimonies to back up your claim so that you are not the only individual providing your point of view. You can hold on to the rental car payment proof and receipts to show that you were legally renting the vehicle. You can also take screenshots of the rideshare app to show that you were driving or on a trip. It will be necessary for you to file an incident report with Uber or Lyft and to also return the car to the rental agency. Finally, it is highly recommended that you hire a skilled Uber and Lyft rental car accident lawyer who can handle your claim for you. You may not know the first thing about lawsuits against a rideshare company or how to prove that you are owed compensation, especially from a rental car business. Our attorneys will be able to secure you the compensation you deserve.
