Getaround Accidents
Getaround is a car rental platform that allows people to rent vehicles for low rates. It offers both weekly rentals and hourly rentals. There is also the possibility for Getaround drivers to drive for Uber through linking the accounts. With the widespread usage of Uber as a transportation method, it is not surprise that many individuals see the benefit in simply renting cars instead of owning them and being responsible for all of the maintenance and upkeep. After all, if your personal car is suddenly out of commission due to an accident, you may not be able to work and drive rideshare. However, that issue is alleviated by renting vehicles for durations of time. With rental cars come many questions regarding accidents and insurance, though. Our team of expert attorneys at the Downtown LA Law Group can handle your lawsuit for you if you were in an accident with a Getaround vehicle.
Getaround Details
Getaround allows you to book a car near you for either personal use or to drive Uber. Uber does offer partnership with the company; to drive, you must link your accounts and sign up. Only specific vehicles can be used to drive for Uber. The fees for Getaround vehicles start at $5 per hour. The more exotic the car or the more amenities and features, the more expensive it is. There are also weekly rates available, which start at $239 per week. You can rent for $219 per week if you commit to a 4-week rental, though. There is also no security deposit needed to drive a Getaround vehicle. When you drive for Uber, your first $60 rental with Getaround is free. This is a different incentive than Uber usually offers to rental car companies, which provides repeated benefits per rental period. With Getaround, you have numerous perks available. Your rental costs include full insurance coverage, unlimited mileage for the vehicles so you can drive as long and as far as you want, around-the-clock customer service and support, roadside assistance, and basic maintenance and upkeep of the vehicle. In order to rent a Getaround car, you must be over the age of 21, have a valid debit or credit card, have a valid driver’s license, have a smartphone with the Getaround app installed on it, and have a valid Facebook or Google account to link to the Getaround app. It is easy to rent a car; you simply browse for the vehicles near you and select the duration of the trip. If you want to drive for Uber, you must select vehicles that allow you to do so. You can then follow normal procedure as you would on any Uber trip.
Getaround Insurance Information – Am I Covered By Insurance In An Accident?
Yes, you are covered by insurance in accident, whether you are driving the Getaround vehicle or if you are using it as an Uber car. Getaround offers perhaps the most sufficient and encompassing insurance coverage for its customers, more so than the other rental car agencies that partner with Uber. With Getaround, you are fully covered with comprehensive, collision, and liability insurance. This means that theft, automobile damage, and physical injuries are all taken care of in the event of an accident. The policy limit is $1,000,000. There are some things to note, however. The renter is responsible for a $1,000 damage fee in the event of an accident. If the car is exotic and listed at a price of over $80,000, or if the car is a classic car and more than 35 years old, then the damage fee is raised to $2,500. Bear in mind that Getaround’s insurance is in effect when you are driving the car, but not when you are driving for Uber. When you are driving for Uber, there are two different stages of insurance that are in effect. The first stage is in effect when the app is on but you have not yet approved a ride. This period allows coverage for $50,000 in liability. Once you accept a ride and you are en route to the customer, as well as when the passenger or passengers are in the vehicle, you will be covered for $1,000,000 in liability, $250,000 in underinsured/uninsured motorist coverage, and more. Your personal auto insurance policy, if you have one, will not be in effect during either period. In the case of Uber, personal policies do not cover commercial driving, or driving that is done for work or pay. Getaround’s insurance is primary.
Is Getaround Liable For Injuries?
Getaround is only liable for your injuries if the company provided a vehicle that was defective (knowingly or unknowingly) or if the company allowed someone to get behind the wheel who should not legally have been allowed to (an intoxicated person or someone with a suspended driver’s license). The majority of the time, rental car agencies cannot be held responsible, but if they could have prevented the accident in some way, then their liability will be called into question.
Steps To Take After An Accident
It can be troublesome to find yourself in an accident with a Getaround vehicle. Car accidents are already irritating, but the different complications from rental agencies, companies like Uber, and more can make the situation needlessly infuriating. If you were in a crash with a Getaround vehicle, you should take these steps to have the best foundation for your insurance claim or lawsuit and to ensure that you are not seriously injured.
- Get medical help at once to prevent further injuries
- Keep medical receipts or paramedic notes
- Take photos of the injuries you suffered and the damage done to the vehicles
- Photograph the scene of the accident and attempt to secure dash cam footage or surveillance videos if available
- Screenshot your Getaround app and Uber trip
- Interview bystanders, passengers, or eyewitnesses and get their statements on how the accident happened or who was at fault
- Retain a copy of the police report if there was an investigation at the scene
- Collect insurance details from any involved parties, as well as personal details
- Avoid towing or trying to repair the car yourself
- Notify Getaround and Uber to the accident as quickly as possible
- Contact an attorney with experience in Getaround car accidents or a lawyer who can handle Uber accident lawsuits
If you do not take action quickly after the accident, your claim may suffer. The insurance agent would love a reason to deny your claim, and if you take too long to go to the doctor and bring up a lawsuit, he could use it as ammunition against you. If you are unsure of how to proceed, we can help you. Our Getaround car crash lawyers are able to negotiate with the insurance company and secure you the compensation you deserve.
Restitution from a Getaround Car Accident
If you were involved in a car accident while driving a Getaround vehicle, you could receive ample compensation for your damages. You may be able to have all your expenses fully covered, especially if you were a victim. We will see to it that you are fully taken care of for the following damages:
- Medical bills for surgery, hospitalization, physical therapy, medication, future procedures, and more
- Property damage for your lost belongings or broken items
- Lost income from the past and future
- Pain and suffering damages for your PTSD, anxiety, fear, emotional trauma, and more
You may have a lot of expenses that racked up after the incident. Without ample representation from an attorney, you run the risk of having your claim rejected and receiving no compensation whatsoever.
Statute of Limitations for a Getaround Car Accident Lawsuit
If you want to file a lawsuit against Getaround for their responsibility in your car accident, you have 2 years from the date of the injuries you suffered to do so. If you do not file a claim within that time period, you will not be able to do so in the future. This prevents claims from dragging on or taking too long to be filed. It gives both parties and ample chance to collect evidence and build their cases. There are a few exceptions to the statute of limitations, though. If you were underage at the time of the accident, perhaps as a passenger, you could wait until you turn 18 years old to sue. You could also wait to sue if you were left physically or mentally incapacitated after the incident. Further, the defendant must be present in the state for the lawsuit to proceed, so if he has outside of the state, the statute of limitations would be temporarily suspended. Many claims are not filed because victims forget about the statute of limitations or take too long to gather their evidence. If you come to our firm for assistance, we will put your evidence together and submit the claim and demand letter to the insurance company for you. We won’t miss a deadline and we will have your case in motion within the appropriate amount of time.
