Statute of Limitations for Medical Malpractice Lawsuits by State
Medical Malpractice Claims are lawsuits filed by patients of licensed medical professionals who have suffered injuries due to their negligent or intentional conduct. There are various statutes which may limit the right of a plaintiff to seek monetary compensation in a Medical Negligence Civil action; the most significant of which is the time period between the injury suffered and the filing of the claim in the court of law. That time period varies greatly based on the jurisdiction where the claim is brought forth and the age of the person filing a claim. In other instance a statute of limitations can be tolled (halted for a period of time) due to many factors including incapacitation of the victim, mental or physical disability, and the status of the individual as a minor.
