According to Postmates, its mission is to transform the way that goods move around cities \u2013 allowing anything to be delivered on-demand. Postmates is a platform that connects customers and couriers to allow the delivery of goods from stores or restaurants in a short length of time. Although Postmates is not just a food-delivery service, most people associate Postmates with just that.<\/p>\n<h2>How Does It Work?<\/h2>\n<p>Postmates works like most other food delivery services. Customers place an order via the app or online. Delivery partners get notified of any orders available for delivery and choose to accept whichever order available. The delivery partners arrive at the designated restaurant to pick up the order\/food and make their way to the customer\u2019s location. Customers have the option to trach the progress of their order from the moment the order it is placed to the moment it is delivered. Both the delivery partner and the customer have the option to contact the other for any concerns related to the order.<\/p>\n<h2>Consumer Complaints Surrounding Postmates\u2019 Service<\/h2>\n<p>According to the Better Business Bureau, there have been more than 1,300 complaints made against Postmates in the last three years; some of these complaints have to do with Postmates failing to issue refunds. Consider some of the following complaints:<\/p>\n<ul>\n<li>December 2019 \u2013 The customer ordered food from Postmates and \u201cthe pasta was overcooked and not edible. [The customer] reported the issue to Postmates, and they offered no resolution.\u201d The customer requested to be contacted by a Postmates manager \u201cand the people in customer service\u2026would not refer [the] request to a manager. [The customer] was [later] sent an email stating [that the restaurant] was the only one that [could] issue a refund.\u201d After contacting the restaurant, the customer was informed that the \u201carrangement with Postmates is that Postmates handles all of the billing and refunds.\u201d The customer contacted Postmates again with this new information, and Postmates continued to deny the refund.<\/li>\n<li>December 2019 \u2013 the customer ordered food from Postmates. The customer was tracking the order \u201cwatched the delivery guy stop nowhere near [the customer\u2019s] neighborhood and mark it as delivered.\u201d The customer \u201cwas instantly charged, with no recourse but a button that said, \u2018ordered not delivered?\u2019 [which gave the option] to either request a refund that would take days or a credit back to the same service that [might not even deliver the order].<\/li>\n<li>November 2019 \u2013 the customer was \u201covercharged 15.00 above the price of [the order].\u201d The customer\u2019s credit card was also allegedly charged twice.<\/li>\n<li>November 2019 \u2013 the customer placed an order on Postmates, but the customer never received the order. The customer contacted Postmates, and \u201cPostmates responded by stating there was nothing they could do and that they could not issue a refund.\u201d<\/li>\n<li>November 2019 \u2013 the customer was charged \u201cthe entire price of [the order] as a cancelation fee after canceling within thirty-seconds of ordering [the food] in order to use a promotional code for free delivery.\u201d<\/li>\n<\/ul>\n<p>&lt;&gt;November 2019 <a href=\"https:\/\/dtla.syfygo.com\/practice-areas\/doordash-class-action-lawsuit-lawyers\/injured-while-making-a-doordash-delivery-is-the-customer-responsible\/\">\u2013 the customer<\/a> made an order that totaled less than . However, the customer was overcharged. The customer was charged $32, an approximate $12 difference. The customer contacted Postmates \u201cat least five times, [and they] repeatedly refused to return the funds.\u201d<\/p>\n<ul>\n<li>October 2019 \u2013 the customer ordered through Postmates but never received the order. After contacting Postmates, the customer was informed that they would not be issuing a refund to the customer\u2019s \u201caccount history.\u201d In other words, Postmates refused to issue a refund because \u201c[the customer] had been issued refunds in the past for discrepancies associated with their business.\u201d<\/li>\n<\/ul>\n<p>These complaints all appear to be perfectly valid; however, customers are not receiving the refunds that they are old. Clearly, the failure to issue refunds is an ongoing issue. Many customers are unhappy because they are being cheated out of their money. Many once-loyal Postmates customers have stopped using the service altogether because of the constant issues.<\/p>\n<h2>Consumers and the Denial of Refunds<\/h2>\n<p>Unfortunately, the denial of refunds hasn\u2019t been a one-off incident. Many Postmates users have had <a href=\"https:\/\/dtla.syfygo.com\/practice-areas\/food-delivery-apps-consumer-issues\/\">issues with their orders \u2013<\/a> issues that they assume warrant refunds. However, they are constantly denied refunds and are left without their cash and without the food they ordered. Some of the common reasons behind the request for refunds (which are often denied) include the following:<\/p>\n<ul>\n<li>The customer never received the order (even if the order is marked as delivered on the app)<\/li>\n<li>The customer receives a damaged order (making it inedible)<\/li>\n<li>The customer receives an incomplete order (missing items)<\/li>\n<li>The customer receives an order that appears to have been tampered with (orders are usually sealed at the restaurant)<\/li>\n<li>The customer receives the wrong order<\/li>\n<li>The customer was billed twice for the order<\/li>\n<li>The customer was overcharged for the order<\/li>\n<\/ul>\n<p>If you encountered any of the issues with your order listed above, it makes sense to expect a full or partial refund. After all, why should you be required to pay for an order with which you are dissatisfied? Unfortunately, the issues listed above \u2013 even though they are no fault of the customer \u2013 are not enough for Postmates to consider distributing refunds.<\/p><\/div>\n<div>\n<h2>Postmates Terms and Conditions<\/h2>\nConsider the following information highlighted in Postmates\u2019 Terms and Conditions, available both online and on the Postmates app:\n<ul>\n \t<li>\u201cCharges paid by you are final and non-refundable\u2026Postmates has no obligation to provide refunds or credits. However, Postmates, in its sole discretion, may provide consumers with refunds, courtesy deliver or product credits, or make promotional offers with different features and different rates to any consumers.\u201d<\/li>\n \t<li>\u201cPostmates reserves the right to charge you the full order amount, including any Postmates fees, if you are not at the designated delivery location when the Courier arrives to complete the delivery.\u201d<\/li>\n \t<li>\u201cIf you cancel your order, you may be charged depending on what stage the order was in when you cancelled. You will be notified of any applicable charges before you complete your cancellation.\u201d<\/li>\n \t<li>\u201cIf an item has to be returned for any reason, you may be subject to a non-refundable $15 return\/restocking fee.\u201d<\/li>\n<\/ul>\nBased on these terms, it seems that Postmates can make charges and issue refunds completely at their own discretion. However, just because something is officially listed on a company\u2019s term and conditions does not mean that it is right.\n<h2>You Could Participate in a Class Action Lawsuit<\/h2>\nIn 2018, Postmates allegedly made 35 million deliveries. Consider the possibility of even just one-quarter of those deliveries having some sort of issue that makes the consumer request a refund. Consider some of the following complaints:<\/p>\\n<ul>\\n<li>December 2019 \u2013 The customer ordered food from Postmates and \u201cthe pasta was overcooked and not edible. [The customer] reported the issue to Postmates, and they offered no resolution.\u201d The customer requested to be contacted by a Postmates manager \u201cand the people in customer service\u2026would not refer [the] request to a manager. [The customer] was [later] sent an email stating [that the restaurant] was the only one that [could] issue a refund.\u201d After contacting the restaurant, the customer was informed that the \u201carrangement with Postmates is that Postmates handles all of the billing and refunds.\u201d The customer contacted Postmates again with this new information, and Postmates continued to deny the refund.<\/li>\\n<li>December 2019 \u2013 the customer ordered food from Postmates. The customer was tracking the order \u201cwatched the delivery guy stop nowhere near [the customer\u2019s] neighborhood and mark it as delivered.\u201d The customer \u201cwas instantly charged, with no recourse but a button that said, \u2018ordered not delivered?\u2019 [which gave the option] to either request a refund that would take days or a credit back to the same service that [might not even deliver the order].<\/li>\\n<li>November 2019 \u2013 the customer was \u201covercharged 15.00 above the price of [the order].\u201d The customer\u2019s credit card was also allegedly charged twice.<\/li>\\n<li>November 2019 \u2013 the customer placed an order on Postmates, but the customer never received the order. The customer contacted Postmates, and \u201cPostmates responded by stating there was nothing they could do and that they could not issue a refund.\u201d<\/li>\\n<li>November 2019 \u2013 the customer was charged \u201cthe entire price of [the order] as a cancelation fee after canceling within thirty-seconds of ordering [the food] in order to use a promotional code for free delivery.\u201d<\/li>\\n<\/ul>\\n<p>&lt;&gt;November 2019 <a href=\\\"https:\/\/dtla.syfygo.com\/practice-areas\/doordash-class-action-lawsuit-lawyers\/injured-while-making-a-doordash-delivery-is-the-customer-responsible\/\\\">\u2013 the customer<\/a> made an order that totaled less than . However, the customer was overcharged. The customer was charged $32, an approximate $12 difference. The customer contacted Postmates \u201cat least five times, [and they] repeatedly refused to return the funds.\u201d<\/p>\\n<ul>\\n<li>October 2019 \u2013 the customer ordered through Postmates but never received the order. After contacting Postmates, the customer was informed that they would not be issuing a refund to the customer\u2019s \u201caccount history.\u201d In other words, Postmates refused to issue a refund because \u201c[the customer] had been issued refunds in the past for discrepancies associated with their business.\u201d<\/li>\\n<\/ul>\\n<p>These complaints all appear to be perfectly valid; however, customers are not receiving the refunds that they are old. Clearly, the failure to issue refunds is an ongoing issue. Many customers are unhappy because they are being cheated out of their money. Many once-loyal Postmates customers have stopped using the service altogether because of the constant issues.<\/p>\\n<h2>Consumers and the Denial of Refunds<\/h2>\\n<p>Unfortunately, the denial of refunds hasn\u2019t been a one-off incident.
