What is REAP?

The Rental Escrow Account Program – REAP – is a city-program designed to address the habitability issues present in rental properties in Los Angeles. The goals of program include reducing blight, preserving the city stock of affordable housing, and protecting tenants from having to live in uninhabitable conditions in their rentals. When the city places a property in REAP, tenants living in the property are eligible for rent reduction. The city creates an account where tenants pay their rent (although they can continue to pay rent directly to landlords). The rental income in this account is withheld from the landlord and can only be access if the landlord applies for it and can prove that they will be making repairs on the rental home. In summary, REAP is supposed to motivate landlords to make necessary repairs to their rental properties to be able to access their rental income again.

Properties could be placed into REAP for many reasons, including but not limited to pest infestations, no access to hot water, no access to running water, no functional heat, no electricity, toxins, etc. It is important to highlight that rental properties are not put into REAP for minor issues. These properties are placed in the program because of significant issues that make the property uninhabitable and can potentially pose a health risk to tenants.

Unfortunately, far too many tenants are unaware of their rights as tenants, so they live in unsafe conditions for months and even for years.

A Review of Your Rights as a Tenant

Although many landlords get away with keeping their rental units in a constant state of disrepair, there are laws that protect tenants. It is important that tenants are aware of the protections in place.

Consider the following:

  • The Warranty of Habitability, as established by California Civil Code 1941.1, states that all rental units must remain in habitable condition. Landlords have the duty to ensure that their rentals are free of toxins, free of pests/vermin, have functional heating and electric, have access to running water, have access to hot water, have sturdy stairs, railings, walls, and floors, have exterior walls, doors, and roof to keep weather out of the unit, and have a generally clean premises, for example.
  • The 1974 case, Green v. Superior Court, established the implied warranty of habitability. That is, even if the rental agreement or lease agreement does not explicitly mention the warranty of habitability, this warranty is still implied. Therefore, the landlord is still liable for keeping their rentals in habitable conditions.
  • The 1981 case, Knight v. Hallsthammar, established that tenants could withhold rent and make repairs themselves if landlords failed to make necessary repairs. Additionally, this case established that tenants have the right to reductions in rent if their units are in disrepair.
