Bus and MTA Metro Blue Line Train Accident Laws – Statute of Limitations for Filing a Bus Train Accident Lawsuit

In Los Angeles most Bus operators and all Metro Trains are solely government owned.  As a result specific and special rules apply to personal injury and accident lawsuits against bus and train operators. Limited Government Liability:  MTA Metrorail Train operators owe a duty as a common carrier for the safety of their passengers.  Most bus line operators and light rail trains in the state of California are government agencies. Under California Government Code Section 810 et seq. rules regarding governmental entities for personal injury liability and compensation for damages under state law a limited waiver of sovereign immunity in provided to victims of personal injury so that they are able to bring their injury claims against the State of California including all public entities. Public Transportation Lawsuits – Limited time to file a lawsuit: California Torts Claims Act requires timely presentation of a written claim for monetary damages given directly to a public entity.  The general statute of limitations for filing a claim against a government entity is six months.  So, if you have been hurt in a bus accident or a train collision  you should act quickly to seek legal representation as the statute of limitations may bar you from recovering for your injuries. Common Injuries Associated with Bus Crashes include
  • Neck injuries and whiplash
  • Spinal Cord Injuries
  • Traumatic Brain Injury
  • Back and Lower Back Lumbar Injury
  • Broken Bones
  • Facial Injury
