A Summary of the Mountain Fire – Latest Information Available

The Mountain Fire started as a 50-acre brush fire at around 9:30am on Wednesday, November 6, 2024, near Bradley Road and Balcom Canyon Road (north of State Route 118 near Camarillo and Somis). Because of critical wind conditions created by the Santa Ana Winds, which reached speeds of up to 100mph, the fire quickly exploded to over 19,000 acres the very next day. The fire quickly burned through entire neighborhoods; residential homes, agricultural properties, and equestrian ranches were burned to the ground. The fire threatened properties in Moorpark, Santa Paula, Camarillo Heights, and Camarillo. Over 10,000 people are under mandatory evacuations.

Overnight (Thursday night into Friday Morning), the fire did not grow significantly due to the winds subsiding. According to Cal Fire, damage inspection crews went in to assess the area and identified 132 destroyed homes, although this number is expected to rise as inspections continue.

The cause of the fire remains under investigation.

Can I File a Lawsuit?

Yes, you could have the right to file a lawsuit for the damages suffered as a result of the Mountain Fire. Based on the details surrounding the fire – specifically, the cause of the fire – affected residents may have grounds to sue public agencies, utility companies, and other private companies. In cases of wildfires, these are usually class action lawsuits or mass torts claims.

Of course, affected residents may also have the right to pursue a claim under their own homeowner’s insurance policy. When insurance companies refuse to pay out on valid claims, affected parties may choose to pursue insurance bad faith claims.

For more information about your right to file a lawsuit, please do not hesitate to reach out to the wildfire damage attorneys here at our law firm as soon as possible.

How Wildfires Can Affect Properties

Of course, wildfire can burn properties to the ground. Entire homes with everything in them can be lost to the flames. Even homes that are not burned down and are still left standing may sustain significant structural damage making the home inhabitable. Homes that were never threatened by flames may sustain significant smoke and ash damage. Because of the damage, residents are likely to experience home value depreciation, which is always devastating. In addition, affected residents are likely to lose their personal property, including sentimental objects that may be considered invaluable to some.

What Determines Case Value? Case value is determined by evaluating a number of factors. These can include the following:
  • The estimated cost of repairs
  • Home value depreciation
  • The estimated value of all lost personal property (furniture, clothing, appliances, electronics, etc.)
  • The estimated value of lost sentimental objects (such as family heirlooms, memorial items, belongings of a deceased family member, photographs, family albums, etc.)
  • Relocation costs (the costs associated with having to live elsewhere due to the fire damage, such as hotel costs, rental fees, etc.)
  • Extent of mental and emotional anguish caused by the incident
  • And more

Examples of Past Payouts due to Wildfires Started by the Negligence of Utility Companies

Many wildfires have been caused by the negligence of utility companies. Consider some of the following settlements awarded throughout the years:

  • $1.16 million settlement – awarded to insurance companies who sued Southern California Edison for damage caused by the Thomas Fire and by the Montecito Mudslides in Ventura County and Santa Barbara County. The fire was sparked by power lines that collided, sending molten metal particles onto dry brush below. This occurred in 2017.
  • $13.5 billion settlement – awarded to victims of the Camp Fire and additional fires sparked around the same time (from 2015 to 2018). The Camp Fire, the Tubbs Fire, and other fires were sparked by PG&E’s equipment.

Although every wildfire is different, wildfires can easily lead to billions of dollars in damages. Because these utility companies are often responsible for wildfires, they usually carry large insurance policies to cover victims affected by fires caused by their equipment.
