This is a very important question – possible the most important question to ask of you are looking into pursuing a lawsuit for human trafficking. Again, failing to file a lawsuit on time could result in losing the right to sue entirely.
In California, Civil Code Section 52.5 establishes the statute of limitations for victims of human trafficking to file civil claims. Specifically, Section (c) of this law states that
“An action brought pursuant to this section shall be commenced within seven years of the date on which the trafficking victim was freed from the trafficking situation or, if the victim was a minor when the act of human trafficking against the victim occurred, within 10 years after the date the plaintiff attains the age of majority.”
In other words, human trafficking civil lawsuits are generally subject to a 7-year statute of limitations if the victim was an adult at the time that the trafficking occurred. However, for minor victims, this is extended to 10 years after the victim reaches 18 – this means that victims who were minors at the time of trafficking could have until the age of 28 to file their lawsuits.
Of course, there are exceptions that could apply, which could toll or pause the applicable deadline. Examples of possible exceptions can include being a minor, lacking legal capacity to make decisions, imprisonment, incompetence, etc., as outlined by section (d)(1) of the law.
