Janod Toy Confetti Trumpets Recall – Product Liability Lawyer
Juratoys recalled 4,000 of its Janod Toy Confetti Trumpets toys on January 13th, 2021. The small plastic pieces inside of the trumpet can loosen and fall out. Children may ingest these pieces, which is a choking hazard.
The toys are small trumpets made of wood. They are red and white in color and the body of the trumpet has colored dots on it. The SKU number is J07632, which can be found on the trumpet’s bell. If the trumpet were sold in the set with other toy instruments, the SKU number is J07626. Only the trumpet in the set of other musical instruments is affected by the recall.
The toys were manufactured in China and imported into Pennsylvania. They were available at various toy stores across the nation, on Maisonette.com, and at Amazon.com. They were sold from January 2019 through November 2020 and could be purchased for $6. The set cost about $50.
There have been no reports that the pieces have caused a choking problem with any children. The company recommends that parents take the trumpets away from their children and dispose of them. They can pursue a full refund from the company.
Choking Hazards from Small ObjectsSmall objects like plastic bits, detachable pieces, and other parts of toys can be very dangerous to children. Children have a habit of putting everything in their mouths, whether to suck, bite, or swallow. The main issue is that these items may be small enough to lodge in the throat, which can make children choke. In other instances, the objects can be swallowed and cause intestinal issues and stomach problems.
A choking child will exhibit specific symptoms. He will not be able to make any sound and he will slowly turn a light shade of blue due to the lack of oxygen. He may flail about and try to get attention. If you can reach and extract the small object, you should do so, or use a variation of the Heimlich maneuver to eject the toy. Taking time to go the hospital may lead to it being too late.

Toy companies are notorious for having small parts and not ensuring that all their toys are safe for children. If you wish to sue Juratoys because your child suffered injuries from one of their defective trumpets, you will need to show that the company was actually negligent. Negligence can be shown in product liability cases in three ways.
- A design error was present with the trumpet
- A manufacturing error was present with the trumpet
- A lack of hazard signs or warnings on the trumpet or packaging
The fact that the bits inside the trumpets can become loose indicates that there was a manufacturing error or oversight in some way. The toys do not have any unique design – many toy trumpets have been manufactured over the years. The pieces should always be in working order, and if they were not, the company can be held liable.
To file a claim, you will need proof that your child was injured. You should take your child to the hospital as soon as you see any sign of injuries. Many children choke and do not show outward signs of panic. Choking should be dealt with immediately, or there is a risk of death. In addition, you should hold on to any receipts and doctor’s statements from the hospital. It is important that you do not hesitate to go to the doctor’s office – the longer you wait to schedule a visit, the more likely your child will suffer other damages, and the more damage it will do to the claim itself. The insurance agent will say that your child was actually hurt because of another product and you’re simply taking advantage of the recall.
You can ask any eyewitnesses, family members, or friends who were nearby to provide you with their statements and testimonies. Your claim will be bolstered if there are more people supporting you who saw your child get hurt or who can testify that the trumpets were defective.
Take photos of the trumpet and how defective it was, showing the broken or detached plastic bits. You can also take pictures of your child’s injuries, if applicable.
Many parents will immediately throw the toy away or get rid of it. Do not dispose of the toy or return it to the store. Do not seek a refund from the company. Do not even try to fix it in any way. Simply put the toy somewhere safe so it can be used as evidence for your claim. Any changes that happen to the toy can be detrimental to the lawsuit. Further, if you don’t have the toy, there would be next to no way to prove that it was defective and was the main cause of injuries in your child.
You may have the receipt showing that you bought the trumpet, or you could have an online order history, a proof of purchase document or email, a credit card statement, or something else. You can add this document to your claim.
All of your evidence can be assembled by an expert product liability lawyer. If you have no legal experience, you may not be able to win the claim. Our attorneys can write the demand letter and go through with the negotiations while you worry about taking care of your child. It is in your best interest to let the leading experts represent you and seek out your deserve compensation.
Earnings from a Product Liability ClaimThe primary factor in determining the value of a case is the degree of injuries. If your child was seriously hurt, the insurance agent will take that into consideration. If the injuries were minor, he will not make as large of an offer. Either way, the insurance agent is most likely to make an offer that won’t cover everything, and we will have to negotiate something better for you. Our law firm will aim to win you the following forms of compensation:
- Medical bills for surgery, hospitalization, physical therapy, medication and prescription drugs, future treatments, and more
- Reimbursement of lost wages from the past and future if you were unable to go back to work
- Payment for broken property, lost personal items, or replacement of anything that was lost in the incident
- Pain and suffering damages for mental trauma, PTSD, fear, anxiety, emotional stress, and more
You should always reach out to a lawyer to ensure that you receive the fairest treatment from an insurance agent. Most of the time, insurance agents will not even look at claims for a few weeks, and they will drag their feet with making offers. They do this in the hopes that you will be desperate for an offer and will simply take the first one they make. Our attorneys know how to negotiate fair deals and ensure that the law is being upheld by the company.
You have two years from the date of the injury to take legal action against Juratoys for injuries from a defective trumpet. If you fail to adhere to the statute of limitations, you will not be able to collect any compensation in the future. The statute of limitations is in effect so that both parties will have sufficient time to gather proof and build a case. If individuals could wait decades before suing, it would be unfair to companies – and if the statute of limitations were too short, victims would not be able to get the damages they deserve. We recommend acting quickly so that you will receive your settlement much sooner.
You can also have the statute of limitations extended if the situation, such as in the following ways:
- A minor is injured, as he can wait until his 18th birthday before the statute of limitations begins to count down
- An individual is left in a coma or mentally unfit to sue, which would allow him to wait until he returns to health and awareness before taking action
- The defendant has vacated California or the country, which would cause the statute to be put on hold until he returns
It is wise to reach out to an attorney to determine the accurate amount of time left on your case. You should act quickly so that you will receive compensation sooner rather than later. Taking too long to pursue legal action can result in your claim getting thrown out or rejected altogether because it exceeded the statute of limitations.
